DJ accused of underage sex after meeting 15-year-old on

A MELBOURNE DJ and dance party promoter had sex with a 15-year-old-girl who contacted him through a MySpace page, a jury heard today.
Prosecutor Michael Hennessy said Paul Vincent Barbaro was a member of the Disco Punks and the girl first saw him perform at a Lush under-age dance party at Docklands in March 2007.
Mr Hennessy said in June that year the girl logged on to the Lush MySpace page and a connection was made when Mr Barbaro posted a bulletin on the same page.
She added him to her MSN page and from there they kept in almost daily contact over the internet.
In his opening address, Mr Hennessy said the accused told the girl that he was 27 and she told him she was 15 and that she did not have a boyfriend.
Mr Barbaro, 31, of Wheelers Hill, has pleaded not guilty in the County Court to three counts of sexual penetration of a child under the age of 16 on August 25, 2007.
The prosecutor said that Mr Barbaro asked the girl to provide photographs of herself naked or in her underwear and she sent them to his mobile phone.
In August 2007, Mr Barbaro telephoned the girl and without thinking about it she gave him her address.
The girl told Mr Barbaro her parents were out and he went to the house, although he knew she was under-age.
Mr Hennessy said Mr Barbaro kissed and touched the girl and they had unprotected sex on a couch before he left when they heard a noise outside.
The prosecutor said there was no allegation that the accused used force and the offence was based on the fact the girl was under 16.
DNA that matched Mr Barbaro's was found on a stain on a couch cushion by investigators.
Defence counsel Peter Haag told the jury that it was Mr Barbaro's case that no penetration occurred.
At the time he went to the girl's house Mr Barbaro had an "honest and reasonable belief" she was 16 and that was sufficient to warrant an acquittal.
Mr Haag said the complainant admitted she told Mr Barbaro "I'm not your average 16-year-old girl".
And it was her initiative to send naked and topless photos to the accused's phone, he said.
