QBH King-hit Murder Charge

springhit
Assault charges for QBH pair upgraded to murder

Something good to come out of something so wrong, be good if they get life :whip:

Enough said :sadgreen:

surprising they skipped straight past manslaughter and landed on murder but at least some well deserved justice has more chance of being done now..

excellent. I had a feeling this would be the case. Since when is punching someone in the head resulting in death not murder? I mean they died directly as a result of this. I bet they aren't too happy with themselves now. Life as they know it will be over. I haven't heard any news of a reopening of qbh, anyone heard anything ?

In a legal sense, what generally matters is the intention, not the end result. If you were to pull out a gun and shoot someone in the head, then this is obviously murder, because you purposely tried to kill them.

Assault with fists or "non-lethal" weapons in self-defence, under duress or in "hot" blood can often be considered manslaughter because the intention was only to cause serious harm and not to kill.

Thus I'm very surprised to hear that this has been classified as murder, seeing as there were no weapons involved. The tapes must have been very damning.
