Internet Radio is considered by the RIAA to be different than terrestrial radio. It is subject to the Digital Millennium Copyright Act (DMCA) and, more importantly, has a different royalty rate structure. This is a complicated issue, but I will attempt to boil it down to the basics.
Terrestrial radio must pay royalties to BMI, SESAC and ASCAP. These societies collect royalties mostly for the composers and songwriters. Internet and Terrestrial Radio both pay these royalties.
But when it comes to record labels and artists, terrestrial radio pays no royalties. Their stations are considered to be of promotional value.
Not so with Internet Radio. Internet Radio stations must pay royalties to an arm of the RIAA called Sound Exchange. Sound Exchange administers royalties for the artists and record labels. The rate is set by the US Copyright Board. |
