File sharing legal in Canada

So it seems that the levy that everyone pays on blank CDs, tapes, minidiscs etc, allows copying of music for private use.

So for instance any downloading you do on P2P networks (kazaa etc) is legal because you're making a copy of a track for your own use.

If I lend someone a CD they can legally make a copy of the CD for themselves. However, I can't make a copy and give it to them.

Interesting...

interesting.....
i just thought that RIAA couldnt go after canadians downloading music because it was outside of their juridsdiction, but that there might be some sort of a small copyright enforcing body in canada

i guess americans (politicians and the suits) have another reason to dislike us :)

No

the cdn version of riaa has like no cash or power to go after people...then again...they made 70 million from the blank recording material levy.

Also the privacy laws in Canada are so strict that it is doubtful that an ISP would be forced to give up a user.

I just don't see it happening at the moment

you're right, canadian ISPs cant give out info on their users, unles a warrant is produced. altho, ISPs can bitch about high traffic volumes on individuals' lines, and they can also cut your service and inquire (by asking you) what type of files you transfer and blah blah
anyhow, the only place it is not safe to be if you dl mp3s is US, but its the whole world scamming the US record labels (i would argue the meaning of that scamming tho)

Good post. I was curious if there was any way all my downloading could be a problem. If it was my ipod would be pretty much useless. I think America is the only place in the world where it is illegal because I know in Europe it is legal. Good to know I am alright, now all I have to deal with the moral delimna of ripping off the artists. hmmmm.

i dont think its actually legal to do this, but its probably not a criminal offense in most of the world and in canada the ppl who watch over this just dont have the budget to go after anyone, they get their salaries through the tax on blank recording media hehe
