I googled for a bit Looks like either a Red-Tailed Hawk, or a Coopers Hawk. More likely a Red-Tailed, IMO.

my trusty western region bird guide helped to point that out, Borders went out of business so i bought it at 60% off. never heard of a cooper's hawk. say don't you live in australia?

I do, yes That's why I have a hard time identifying north American hawks - I know all the Australian ones, but not the ones over there

Well, many of the continents were all joined together, millions of years ago (see: Gondwanaland) so they've been here the whole time, and just evolved differently to other continents' birds based on the environment around them here. Also, they can fly a long way, which helps Here in Brisbane, where I live, we get a lot of birds that migrate down from Papua New Guinea, Indonesia, and India depending on the season.
